Mitä henkilötietoja keräämme ja miksi?

Academic Work kerää henkilötietoja sinusta tarjoamamme palvelun laajuudessa. Henkilötietojesi kerääminen ja sitä seuraava käsittely on välttämätöntä, jotta voimme täyttää velvollisuutemme sinua kohtaan käyttöehtojen mukaisesti tai siten kuin on välttämätöntä käsittelyn tarkoituksen täyttämiseksi. Meidän saattaa täytyä esimerkiksi säilyttää tiettyjä tietoja sinusta täyttääksemme lakisääteiset velvoitteet, kuten työlainsäädännön tai kirjanpitosääntelyn asettamat velvoitteet.

Keräämme myös luvallasi henkilötietojasi evästeiden avulla, kun vierailet internetsivullamme. Internetsivun vierailijana sinulla ei ole velvollisuutta antaa meille pääsyä henkilötietoihisi ja voit välttää tämän olemalla hyväksymättä evästekäytäntöämme laitteellasi. Miten saamme pääsyn henkilötietoihisi?

Sinusta säilyttämämme henkilötiedot ovat sellaisia, jotka olet antanut meille suurimmaksi osaksi kirjautuessasi käyttäjäksi internetsivuillemme, hakiessasi Academic Workin kautta työpaikkaa tai ollessasi meihin yhteydessä muutoin liittyen palveluihimme ja toimintaamme, tai jotka olet jakanut julkisesti työelämään liittyvillä alustoilla, kuten LinkedIn.

Kenen kanssa jaamme henkilötietojasi?

Joissain tapauksissa saatamme jakaa henkilötietojasi ulkopuolisten osapuolten kanssa. Näitä voivat esimerkiksi olla toimittajat tai viranomaiset, joille meillä on lakisääteinen velvollisuus antaa tiettyjä tietoja. Kun jaamme henkilötietojasi ulkopuolisen osapuolen kanssa, teemme niin ainoastaan tarkoituksiin, joihin tiedot alun perin kerättiin. Käytämme aina tarvittavia turvatoimenpiteitä varmistaaksemme, että ulkopuolinen osapuoli käsittelee tietojasi oikealla ja turvallisella tavalla, kuten solmimalla sitovia sopimuksia toimittajiemme kanssa.

Henkilötietojasi voidaan jakaa seuraavien ulkopuolisten osapuolten kanssa:

Academic Work -konsernin yhteisöt – Voimme joskus jakaa tietojasi muiden konsernimme yhteisöjen kanssa. Näin voi tapahtua esimerkiksi rekrytointiprosessin yhteydessä, kun toinen yhteisö tarjoaa palveluita, jotka voivat johtaa henkilötietojesi käsittelyyn puolestamme tai kun tietojasi käsitellään koko konsernin käyttämissä järjestelmissä.

Toimittajat ja yhteistyökumppanit – Voimme joskus jakaa henkilötietojasi toimittajillemme ja yhteistyökumppaneillemme, kuten IT-toimittajille säilytykseen ja operatiivisen toiminnan hallinnointiin sekä markkinointityökalujen, rekrytointityökalujen ja persoonallisuustestien toimittajille. Academic Work toimii yhdessä Alva Labsin kanssa yhteisrekisterinpitäjänä psykometrisissä testeissä, jotka ovat osa Academic Workin rekrytointiprosessia. Tarkoittaen, että Academic Work ja Alva Labs jakavat vastuun henkilötietojen käsittelystä testien osalta. Jotta testit ovat hakijoiden saataville rekrytointiprosessin aikana, Academic Work jakaa henkilötietoja Alva Labsin kanssa. Alva Labsin yhteystiedot: legal@alvalabs.io.

Viranomaiset – Jos kansallinen tai kansainvälinen lainsäädäntö edellyttää, saatamme joutua jakamaan henkilötietojasi viranomaisten kanssa, kuten Suomen veroviranomaisen (Verohallinto) tai Kansaneläkelaitoksen (Kela) kanssa.

Asiakkaat – Jos haet työpaikkaa Academic Workin kautta ja etenet rekrytointiprosessissa kauttamme, esitämme tietosi lopuksi asiakkaallemme. Asiakas on vastuussa siitä, miten he käsittelevät vastaanottamiaan tietoja. Jos sinulla on kysymyksiä siitä, miten asiakkaamme käsittelevät henkilötietojasi, suosittelemme kääntymään suoraan heidän puoleensa. Academic Work avustaa sinua mielellään yhteydenotossa.

Voit aina ottaa meihin yhteyttä saadaksesi yksityiskohtaisempia tietoja siitä, mille ulkopuolisille osapuolille jaamme henkilötietojasi.

Missä käsittelemme henkilötietojasi?

Teemme aina parhaamme varmistaaksemme, ettei henkilötietojasi säilytetä tai muutoin käsitellä EU/ETA:n ulkopuolisissa maissa. Jos henkilötietojasi siirretään EU/ETA:n ulkopuolisiin maihin, käytämme tarvittavia suojatoimenpiteitä varmistaaksemme, että henkilötietojasi käsitellään tavalla, joka on soveltuvien tietosuojalakien mukainen, kuten käyttämällä asianmukaisia suojatoimenpiteitä siirrossa. Toimittajamme saattavat käsitellä henkilötietojasi Norjassa, Sveitsissä, Kanadassa, Iso-Britanniassa tai Yhdysvalloissa. Näissä tapauksissa sovelletaan Tietosuoja-asetuksen artikla 45:n mukaista päätöstä riittävästä tietojen suojaamisen tasosta tai Euroopan komission vakiolausekkeiden, artiklan 46 suojatoimia. Jos tietojasi siirretään EU/ETA:n ulkopuolelle, varmistamme riittävät turvatoimet (kuten vakiolausekkeiden, sopimusteknisten, organisaatiotasoisten ja/tai teknisten suojausten käyttö), eli tietojasi käsitellään tavalla, joka täyttää asetuksen vaatiman suojauksen tason. Jos haluat kopion käytetyistä suojatoimenpiteistä tai jos haluat lisää tietoja siitä, missä henkilötietojasi käsitellään, voit aina olla meihin yhteydessä.

Lainmukainen peruste

Academic Workin vastuulla on esittää lainmukainen peruste jokaiselle henkilötietojen käsittelylle. Jos lainmukaista perustetta ei ole, käsittely ei ole laillista, eikä siten sallittua. Yksityisten yritysten osalta perusteet voidaan pääosin jaotella seuraaviin neljään luokkaan:

Lakisääteinen velvoite
Oikeutettu etu

Kun perusteena käytetään oikeutettua etua, suoritamme aina huolellisen arvion, missä otamme omien tietojesi käsittelyä puoltavien perusteidemme lisäksi huomioon sinun oikeutesi kieltää niiden käsittely. Mitä oikeuksia sinulla on?

Soveltuvat tietosuojalait antavat sinulle useita oikeuksia, kun henkilötietojasi käsitellään. Alta löydät lyhyen kuvauksen näistä oikeuksista. Sinulla olevat oikeudet voivat vaihdella riippuen siitä, minkä tarkoitusten vuoksi käsittelemme tietojasi. Kuten edellä on mainittu, Academic Work ja Alva Labs toimivat yhteisrekisterinpitäjinä koskien rekrytointitestien yhteydessä käsiteltäviä henkilötietoja. Oikeus saada tietoa – Sinulla on oikeus saada tieto siitä, miten käsittelemme henkilötietojasi. Selvitys henkilötietojen käsittelystä tulee meidän toimestamme tarjota silloin, kun tietoa kerätään sekä erikseen pyytäessä. Tästä voit lukea lisää alta, kohdasta ’’Oikeus saada pääsy tietoihin’’. Jos henkilötiedoillesi tapahtuu jotain, mikä voi aiheuttaa sinulle haittaa, meillä on velvollisuus ilmoittaa tästä sinulle. Lisätietoa oikeudestasi saada tietoa löydät täältä.

Oikeus suostumuksen peruuttamiseen - Kun oikeutemme käsitellä henkilötietojasi perustuu suostumukseesi, sinulla on oikeus peruuttaa suostumuksesi. Helpoin tapa peruuttaa suostumus on ottamalla yhteyttä privacy@academicwork.fi. Kunnes perut suostumuksesi, meillä on lainmukainen peruste ja siten oikeus käsitellä henkilötietojasi. Suostumuksen perumisen jälkeen keskeytämme tietojesi käsittelyn.

Oikeus saada pääsy tietoihin – Jos Academic Work käsittelee henkilötietojasi, sinulla on oikeus pyytää vahvistusta tästä seikasta ja saada tietoja käsittelystä. Sinulla on myös oikeus pyytää kopiota sinusta käsittelemistämme henkilötiedoista veloituksetta.

Oikeus tietojen oikaisemiseen – Joissain tapauksissa sinulla on oikeus pyytää Academic Workia oikaisemaan tietosi, jotka ovat mielestäsi virheelliset tai puutteelliset. Sinulla on joka tapauksessa aina mahdollisuus muuttaa tietoja, jotka olet lisännyt hakijaprofiiliisi.

Vastustamisoikeus – Joissain tapauksissa sinulla on oikeus vastustaa Academic Workin suorittamaa henkilötietojesi käsittelyä, kuten silloin, kun se koskee suoramarkkinointia. Kaikissa tapauksissa, joissa käsittelemme henkilötietojasi oikeutetun etumme perusteella (yllä olevan taulukon mukaisesti), sinulla on mahdollisuus vastustaa käsittelyä. Jos vastustat käsittelyä, lopetamme henkilötietojesi käsittelyn.

Oikeus käsittelyn rajoittamiseen – Joissain tapauksissa sinulla on oikeus pyytää Academic Workia rajoittamaan henkilötietojesi käsittelyä, esimerkiksi tapauksissa, joissa kiistät, että sinusta käsittelemämme tiedot ovat paikkansapitäviä. Voit tällaisissa tapauksissa pyytää meitä rajoittamaan henkilötietojesi käsittelyä aikana, jolloin tarkistamme tietojesi paikkansapitävyyden. Niissä tapauksissa voimme käsitellä henkilötietojasi ainoastaan hyväksynnälläsi, lukuun ottamatta tilanteita, joissa Academic Work laatii, esittää tai puolustautuu oikeusvaateelta suojellakseen jonkun muun oikeutta tai suojellakseen tärkeää julkista etua.

Oikeus tietojen poistamiseen – Joissain tapauksissa sinulla on oikeus pyytää Academic Workia poistamaan henkilötietosi. Tämä oikeus soveltuu seuraavissa tilanteissa:

Jos tiedot eivät enää ole välttämättömiä tarkoituksiin, joihin ne kerättiin.
Jos peruutat suostumuksesi eikä meidän tarvitse säilyttää tietojasi muihin tarkoituksiin, kuten lakisääteisten velvollisuuksien vuoksi.
Jos vastustat oikeutettuun etuun perustuvaa käsittelyä ja syysi vastustamiselle on painavampi kuin etumme.
Jos vastustat suorittamaamme henkilötietojesi käsittelyä suoramarkkinointitarkoituksiin eikä meidän tarvitse käsitellä tietojasi muihin tarkoituksiin.
Jos henkilötietojasi käsitellään laittomalla tavalla.
Jos henkilötietosi on poistettava lakisääteisen velvollisuuden vuoksi.

Ota ystävällisesti huomioon, että meillä saattaa joka tapauksessa olla velvollisuus tallentaa henkilötietosi esimerkiksi kanssasi tehdyn sopimuksen tai lakisääteisen velvollisuuden takia. Näissä tapauksissa käsittelemme henkilötietojasi ainoastaan sanottuun tarkoitukseen. Joissain tilanteissa lakien ja säädösten vaatimukset tietojen säilytyksestä ja käsittelystä saattavat ylittää oikeutesi vaatia tietojen poistamista. Näissä tilanteissa meidän vastuullamme on esittää lainmukainen peruste tietojesi käsittelyn jatkamiselle. Sinulla on myös oikeus vastustaa tietojesi käyttöä tiettyihin tarkoituksiin, kuten suoramarkkinointiin, mistä voit lukea lisää otsikon ’’Vastustamisoikeus’’ alta.

Oikeus siirtää tiedot järjestelmästä toiseen – Tapauksissa, joissa käsittelemme henkilötietojasi suostumuksellasi tai täyttääksemme sopimuksen kanssasi, sinulla on oikeus saada meille antamasi henkilötiedot jäsennellyssä muodossa. Voit tehdä tällaisen poiminnan Omilla Sivuillasi osoitteessa www.academicwork.fi. Kun käytät oikeuttasi tietojen siirtoon, olet oikeutettu siirtämään henkilötietosi suoraan Academic Workiltä toisen ylläpitäjän rekisteriin, olettaen sen olevan teknisesti mahdollista.

Jos haluat käyttää oikeuksiasi, voit aina olla meihin yhteydessä alla olevien yhteystietojen välityksellä. Jos et ole tyytyväinen siihen, miten Academic Work käsittelee henkilötietojasi, sinulla on aina oikeus tehdä valitus valvontaviranomaiselle, ensisijaisesti siinä EU-maassa, jossa asut, työskentelet, tai jossa väitetty rikkomus on tapahtunut. Suomessa toimivaltainen viranomainen on Tietosuojavaltuutettu.

INFORMATION ABOUT OUR PROCESSING OF YOUR PERSONAL DATA

What personal data do we collect and why?

Academic Work will collect personal data about you within the scope of the services we provide. The collection and subsequent processing of your data is necessary in order for us to fulfil our obligations towards you in accordance with the User Terms or as further needed to fulfil the data processing purpose. We may need to keep certain data about you in order to fulfil legal obligations, such as those imposed by labour laws or accounting regulations.

We will also collect your personal data when you visit our website by using cookies – with your approval. You can read more about how and when we use cookies here. As a website visitor, you are not obligated to give us access to your personal data and can avoid this by not accepting our use of cookies on your device.

How do we get access to your personal data? The personal data that we store about you is data that you provided us with yourself, such as when you register as a user on our website, when you apply for a job via Academic Work, when you contact us regarding other matters like our services and business, or information that you have made public via professional networks that you are a user of, such as LinkedIn.

Who will we share your personal data with? In some cases, we might share your personal data with external parties. The external parties are other companies within our Group, vendors to Academic Work, authorities that we are under a legal obligation to provide with certain information, or customers when applicable. When we share your personal data with an external party, it will only be for those purposes for which the data was initially collected. We will always take the necessary precautions to ensure that the external party processes your data in a correct and secure manner, such as by entering into binding agreements with our vendors.

Your personal data may be shared with the following external parties:

Entities in Academic Work Group – We may share your information with other entities in Akind Group (the Group that Academic Work belongs to). This may occur when another Group company provides services to us that may result in processing your data on our behalf or when we work in group-wide applications.

Vendors – Your personal data may sometimes be shared with our vendors who perform services on our behalf and based on our instructions. These may be vendors of IT vendors used for storage and operations management, vendors of marketing tools, font embedding tools on our website, recruitment tools, and tests within a specific business area (IT or Finance for example). Academic Work is joint controller with Alva Labs for the “Ability test” which is a part of Academic Work’s recruitment process. This means that Academic Work and Alva Labs shares responsibility for handling of personal data in relation to the Ability tests. Because of this Academic Work will share personal data with Alva Labs, in order to make the Ability tests available to candidates during the recruitment process. Authorities – If required by national or international legislation, we may need to share your personal data with authorities, such as the Finnish Tax Authority (Verohallinto) or the Finnish Social Insurance Institution (Kela).

Clients – If you apply for a job via Academic Work and progress through the recruitment process, we will present your information to our client at the end of the process. The recruiting client is responsible for how they handle the data that they receive. If you have questions about how our clients handle your personal data, we recommend that you turn directly to them. Academic Work is happy to assist you in contacting them.

You are always welcome to contact us for more detailed information about which external parties we share your personal data with.

Where do we process your personal data?

We always do our best to make sure that your personal data is not stored or otherwise processed in countries outside of the EU/EEA. However, your personal data may be transferred or processed at our suppliers in Canada, Norway, Switzerland, the UK, or the USA. In such circumstances, either a decision on an adequate level of protection is applied, in accordance with Article 45 of the General Data Protection Regulation, or appropriate protective measures are applied in accordance with Article 46 of the General Data Protection Regulation in the form of the European Commission's decided standard contractual clauses. If your data is transferred or handled in countries outside the EU/EEA, we will ensure that we have taken sufficient security measures (such as Standard Contractual Clauses (SCC), contractual, organizational and/or technical safeguards) which mean that your data is handled in a way that achieves a sufficient level of protection according to applicable regulations. If you would like a copy of the safeguards used or if you would like more information about where your personal data is processed, you are always welcome to contact us.

Legal basis

Academic Work must document a lawful basis for each processing of personal data. If there is no legal basis, the processing is not lawful and thus not permitted. Private companies and organizations can rely primarily on these following four bases:

Consent
Performance of contract
Legal obligation
Legitimate interest

When using legitimate interest as a basis, we always conduct a balancing test from which we assessed that our legitimate interest in carrying out the processing outweighs your interest in not processing your personal data. What rights do you have?

Applicable privacy regulations provide you with a number of rights when your personal data is processed. Below you will find a short description of those rights. What rights you have may vary depending upon the purposes for which we are processing your data. As mentioned above, Academic Work is, together with Alva Labs, joint controller for the processing of personal data that occurs for the “Ability test”, during the recruitment process. Therefore, note that you can also turn to Alva Labs for rights requests as well. Contact information to Alva Labs: legal@alvalabs.io, Alva Labs DPO: dpo.alvalabs@gdprhero.se.

Right to information - You have the right to receive information about our processing of your personal data. Information about the processing of personal data must be provided by us as the data controller both when the data is collected and when you request access to it, which you can read more about under the heading “Right to access” below. If something happens with your personal data that could affect you negatively, we have an obligation to inform you about this. You can read more here.

Right to withdraw consent - When our right to process your personal data is based on your consent, you always have the right to withdraw your consent. The easiest way for you to do this is by contacting privacy@academicwork.fi. Until you withdraw your consent, we have a legal basis and thus the right to process your personal data. After your consent is withdrawn, we will stop processing your personal data.

Right to access – You have the right to know if Academic Work processes your personal data and to receive a copy of your personal data – a register extract – free of charge. The register extract will state what information we have about you, the purpose of the personal data processing, and how we process your personal data.

Right to rectification – You always have the right to demand that Academic Work corrects incorrect or incomplete information about you and that we supplement your information. Additionally, you always have the opportunity to change the information you provided in your candidate profile.

Right to object – You have the right to object to Academic Work’s processing of your personal data, such as when it concerns direct marketing (including profiling). In all cases where we process your personal data based on our legitimate interest (including profiling), you have the possibility to object to the processing. If you object and notify us, we will stop processing your personal data.

Right to restriction – In some cases, you have the right to request that Academic Work restricts the processing of your personal data. This applies if, for example, you question that the personal data we process is correct. You can then request a restriction of processing for the time that we need to verify whether the personal data is correct. In that case, we may only (in addition to the storage itself) process the data upon your consent. It applies with the exception of establishing, asserting, or defending legal claims, to protect someone else’s right, or to protect an important public interest.

Right to erasure – As a starting point, you have the right to request that Academic Work delete your personal data. This applies in the following cases (among others):

If the data is no longer necessary for the purposes it was collected for.
If you withdraw your consent and we do not need to keep your data for other purposes, such as legal obligations.
If you object to processing based on legitimate interest and your reason for objection outweighs our interest.
If you object to our processing of your data for direct marketing purposes and we do not need to process your data for other purposes.
If your personal data is processed in an illegal manner.
If your personal data must be deleted due to legal obligations.

In some cases, Academic Work does not have the possibility to delete your personal data. This occurs when the data is either still necessary to process for the purpose for which it was collected or because there is a legal requirement that Academic Work must keep it for a certain period of time. It may also be because Academic Works' interest in continuing to process the data outweighs your interest in having it deleted, which we then need to be able to demonstrate decisive justified reasons why our processing outweighs your interests. You can read more about the legal requirements that apply to Academic Work regarding saving information even if you request to have your personal data deleted on the Finnish Authority for Privacy Protection's website. The laws described in this document therefore prevent us from immediately deleting certain data. You also have the right to object to us using your personal data for certain purposes such as direct marketing, which you can read more about under the heading Right to object which you can find above.

Right to data portability – In cases where we process your personal data with your consent, or to fulfill an agreement you entered with us, you have the right to demand that Academic Work provide you with the personal data you have given us in a machine-readable format. When exercising the right to data portability, you have the right to transfer your personal data directly from Academic Work to another personal data controller when this is technically possible. Right to lodge a complaint – If you are dissatisfied with the way Academic Work processes your personal data, you always have the right to lodge a complaint with a supervisory authority, in particular in the Member State where you have your domicile or place of work or where the alleged infringement was committed (stated in Article 77 of the GDPR).
